Tell Your Senators: Jack McConnell is Unfit for Federal Bench!
Last night, Harry Reid filed cloture on Jack McConnell, a highly controversial, pro-choice, anti-business, pro-judicial activism nominee for a lifetime judicial appointment to the Federal District Court for the District of Rhode Island.
Extensive Liberal Political Involvement
It seems that McConnell’s greatest qualifications for the federal bench are his generous donations to liberal candidates and his support for liberal policies.
McConnell and his partners at personal injury law firm Motley Rice have made over $720,000 in federal campaign contributions, including direct contributions to Senators who will vote on his confirmation.
Additionally, McConnell and his wife contributed $31,028 to President Obama’s Victory Fund, $50,000 to his Presidential Inaugural Committee, and $6,000 to former White House Chief of Staff Rahm Emanuel.
McConnell has served and donated heavily to pro-abortion causes. He disclosed in his public questionnaire that he was director of Planned Parenthood of Rhode Island from 1997 until 2001. Additionally, McConnell made multiple donations to EMILY’s List, a group whose sole purpose is to support pro-abortion female candidates. According to OpenSecrets, Jack McConnell made a $1,000 donation to EMILY’s List in 2008 and another $1,000 donation in 2005.
Unqualified for the Bench
The American Bar Association gave McConnell a less than average rating. For a practicing lawyer with 25 years of experience to obtain such a low rating speaks poorly of his legal abilities.
Additionally, McConnell’s own statements indicate that he believes in activist government and an activist judiciary. McConnell has publicly declared that he favors “an active government” that should not “stand on the sidelines” when it comes to pursuing his vision of a just result. He said of himself, “I am an emotional person about injustice at any level — personal, societal, global” and that there are “wrongs that need to be righted, and that’s how I see the law.”
Anti-Business and Lacking Impartiality
The Chamber of Commerce, which has never before weighed in on a district court nomination, is actively opposing McConnell’s nomination because of his anti-business bent. McConnell made tens of millions of dollars suing corporations, and has made numerous anti-business statements, even singling out corporations by name. As part of his involvement in a tobacco settlement case, he will draw $3 million per year until 2024 from his former law firm, one of the nation’s largest plaintiff’s law firms. This could present serious conflicts of interest.
During his confirmation hearing before the Senate Judiciary Committee, McConnell misled the Senate about his involvement in a matter over which his former law firm is currently being sued for wrongdoing. He testified that he had no involvement with the suit, but he later testified in depositions that he had significant involvement with the documents that form the basis of the suit.
Conservative Senators often defer to the President and vote for nominees they might not prefer, because they believe it is the President’s prerogative to appoint nominees that reflect his values. But, this is an extraordinary circumstance, as McConnell’s poor ABA rating, extensive political donations to liberal candidates and causes, numerous anti-business, pro-judicial activism statements and misleading statements to the Senate Judiciary Committee make him patently unfit for the federal bench.
Call Your Senators and tell them to vote NO on McConnell because he is unfit for the federal bench.
